These Terms of Service (“Terms”) govern your use of the website and patient portal operated by Chiro Shack LLC / Aperta Health (“we,” “us,” or “our”). By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Services Provided

We provide chiropractic care services through our clinics in Idaho Falls and Middleton, Idaho, operating under the Chiro Shack and Aperta Health brands. Our website and patient portal allow you to schedule appointments, manage memberships, make payments, and access your account information.

2. Patient Accounts

To access the patient portal, you must create an account with accurate, current, and complete information. You are responsible for:

  • Maintaining the confidentiality of your password
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized use of your account
  • Keeping your contact information up to date

You must be 18 years of age or older to create an account. Minors may receive care with parental or guardian consent and account management.

3. Appointments and Cancellations

Booking: Appointments booked online are subject to availability. A confirmed appointment does not guarantee a specific provider unless specified.

Cancellations: We ask that you cancel or reschedule at least 2 hours before your appointment time. Late cancellations and no-shows may result in a standard visit fee being charged.

New patients: New patient appointments are scheduled exclusively (no other patients in the same time slot) and may require additional intake time.

4. Membership Program

The Aperta Health membership program (“Membership”) is billed monthly via Stripe. By enrolling, you authorize recurring charges to your payment method.

  • Individual: $19/month — covers one named member
  • Partner Plan: $19/month base + $10/month per partner added
  • Family: $39/month — covers a family at the same address

Member visit rate: $22 per adjustment (vs. $49 standard). Member pricing applies only while your membership is active.

Cancellation: You may cancel your membership at any time from your account portal. Cancellation takes effect at the end of the current billing period — you retain member pricing until then. No refunds are issued for partial months.

Price changes: We reserve the right to change membership pricing with 30 days' advance notice. Continued membership after the notice period constitutes acceptance.

5. Payments

All payments are processed by Stripe. We do not store your credit card number or payment details. By providing payment information, you agree to Stripe's Terms of Service and Privacy Policy.

Visit fees are due at time of service or at time of booking for online payments. Membership fees are charged on a recurring monthly basis.

6. SMS Communications Program

Program: Chiro Shack SMS — appointment reminders, care follow-ups, and direct provider communications.

How to opt in: You consent to receive SMS messages by providing your mobile phone number when booking an appointment at chiroshack.com or in person at a Chiro Shack clinic.

Message frequency: Message frequency varies. You may receive messages related to upcoming appointments, post-visit follow-ups, and direct communications from your provider.

Rates: Message and data rates may apply. Chiro Shack does not charge for SMS messages, but your mobile carrier's standard rates apply.

To opt out: Reply STOP to any message at any time. You will receive one final confirmation message and no further SMS will be sent.

SMS consent is not a condition of receiving care or purchasing any services. We do not share your mobile number with third parties for their marketing purposes.

7. Prohibited Uses

You agree not to:

  • Use the site for any unlawful purpose
  • Provide false or misleading information
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with the proper functioning of the website or portal
  • Scrape, copy, or redistribute our content without permission
  • Use automated tools to book appointments in bad faith

8. Intellectual Property

All content on this website, including the Chiro Shack and Aperta Health names, logos, and design, is the property of Chiro Shack LLC and may not be used without written permission.

9. Disclaimer of Warranties

Our website and portal are provided “as is” without warranties of any kind, express or implied. We do not warrant that the site will be uninterrupted, error-free, or free of viruses. We are not responsible for decisions you make based on information found on our site.

10. Limitation of Liability

To the fullest extent permitted by law, Chiro Shack LLC / Aperta Health shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability to you shall not exceed the amount you paid us in the three months preceding the claim.

11. Governing Law

These Terms are governed by the laws of the State of Idaho. Any disputes shall be resolved in the courts of Bonneville County or Ada County, Idaho, as applicable to the location of care.

12. Changes to These Terms

We may update these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a new “Last updated” date, or by email for significant changes. Continued use of our services after changes are posted constitutes acceptance.
